Background: These are a list of common requests for artwork commissions which to me seem common sense but I've created this page to make these points clear and avoid misunderstanding.
I've made everything as balanced to both artist and commissioner as possible.
Of course everything is open to negotiation up front but modifications must be agreed upon before payment.
- Display rights: Commissioner may display art in public, both personally and on the internet, at location(s) of his choosing. Artist may display upon the same terms unless privacy is specifically
requested for the commission.
- Signature: Handwritten artist's signature permitted (preferred, actually, as a reminder of the artist's name). Embedded text/watermarks/URLs for credit requested by either party
should provide example for approval before payment.
- Credit: Artist credits commissioner, commissioner credits artist. This is done in the description field on gallery sites. Optional but a kind gesture on 140-character platforms.
- Resolution: Both parties have the right to display the picture at full resolution with an art gallery's zoom feature. Resolution should be discussed before payment.
Commissioner may re-scan traditional artwork at a higher resolution keeping artist's handwritten signature visible.
- Original (for traditional art): Artist gives commissioner first opportunity to receive original artwork. If there is an additional charge for the original (for shipping or otherwise)
it should be included in any pricing quotes.
- Resale: Artist may not resell the depiction of commissioner for personal money received, commissioner may not resell artist's artwork for personal money received. Charity events with zero
personal funds received are permitted (but duplication for resale is not permitted even for charity).
- Payment: Is not to be made earlier than 150 days prior to completion of artwork. If delayed for any reason, commissioner is entitled to receive a refund and re-submit payment after
art is completed.
- Edits: Subject to any specific policy in artist's TOS, but artist should provide incremental sample art to correct any errors early.
